These Terms of Service ("Terms") govern your use of the 40T-Secure AI platform operated by 40T Secure AI, Inc. ("we", "us", or "our"). By using our service, you agree to these Terms.

1. SERVICE DESCRIPTION

40T-Secure AI is a cookie compliance intelligence platform that:

• Analyzes website cookies for regulatory compliance
• Provides risk assessments across 19 global jurisdictions
• Generates compliance reports and recommendations
• Offers API access for enterprise integrations

Important: 40T-Secure AI provides compliance intelligence and risk assessment. It does not constitute legal advice and is not a substitute for qualified legal counsel.

2. ACCOUNT REGISTRATION

To use our service, you must:

• Create an account with accurate information
• Be at least 18 years old
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activity under your account.

3. SUBSCRIPTION AND PAYMENT

Free Tier: Limited features at no cost, subject to usage limits.

Paid Plans:

• Billed monthly or annually in advance
• Processed securely via Stripe
• Auto-renew unless cancelled before renewal date
• No refunds for partial billing periods

We reserve the right to modify pricing with 30 days' notice.

4. ACCEPTABLE USE

You agree NOT to:

• Use the service for illegal purposes
• Scan websites without proper authorization
• Attempt to bypass security measures or rate limits
• Reverse engineer, decompile, or copy our technology
• Share account credentials with unauthorized parties
• Use automated tools to abuse the service
• Resell access without written permission

Violation may result in immediate account termination.

5. INTELLECTUAL PROPERTY

Our IP: The 40T-Secure AI platform, algorithms, reports, and branding are our proprietary property.

Your Data: You retain ownership of data you submit. You grant us a license to process this data to provide the service.

Reports: You may use generated reports for your internal business purposes and share with your legal/compliance teams.

6. DATA AND PRIVACY

Our Privacy Policy governs data collection and use. By using the service, you consent to our data practices.

7. DISCLAIMER OF WARRANTIES

40T-Secure AI is a compliance intelligence tool, not legal advice. Compliance determinations require qualified legal counsel.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability is limited to fees paid in the prior 12 months
• We are not liable for regulatory fines, penalties, or enforcement actions

9. INDEMNIFICATION

You agree to indemnify and hold harmless 40T Secure AI from claims arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of third-party rights

10. TERMINATION

By You: Cancel anytime from account settings. Access continues until period end.

By Us: We may suspend or terminate for Terms violations, non-payment, or extended inactivity (12+ months).

Effect: Upon termination, your right to use the service ends. Data deletion per our Privacy Policy.

11. MODIFICATIONS

We may modify these Terms with notice via email or platform notification. Continued use constitutes acceptance.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

13. DISPUTE RESOLUTION

Any disputes shall be resolved through binding arbitration under AAA rules, except for injunctive relief which may be sought in court.

14. GENERAL PROVISIONS

• Entire Agreement: These Terms constitute the complete agreement
• Severability: Invalid provisions do not affect remaining Terms
• Waiver: Failure to enforce does not waive future rights
• Assignment: You may not assign without consent; we may assign freely
